The terms on which TRC Marketing provides websites, booking systems and advertising management.
These terms apply to your use of this website and, where you engage us, to the services we provide. "We", "us" and "TRC Marketing" mean TRC Marketing, a sole proprietorship operated by Tyler in Suffield, Connecticut. "You" means the business engaging us or the person using this site.
Where you sign a separate written agreement or order form with us, that document governs if it conflicts with anything here.
Depending on the package agreed, services may include building a website, setting up online booking, setting up a customer relationship system with automated follow up, and building and managing advertising campaigns on Facebook and Instagram. The specific scope is whatever is written in your order form or quote.
We do not provide social media posting or community management, search engine optimisation as a standalone service, legal advice, tax advice, accounting advice or investment advice.
If a payment fails or is more than ten days late, we may pause the service, including advertising, until it is settled. We will tell you before we do.
Where offered, the first fourteen days of advertising management on the Growth bundle carry no management fee. The trial covers our management work only. You remain responsible for your own advertising spend during the trial, which is paid by you directly to the advertising platform.
The trial runs from the day the first campaign goes live. At the end of it, monthly fees begin unless you tell us before the fourteenth day that you do not wish to continue. If you do not continue, nothing further is owed, the advertising account remains yours, and any setup fee already paid covers the work already done and is not refunded.
The trial is available once per business.
Advertising spend is never included in our fees. It is paid by you, directly to the advertising platform, from an account registered in your name with your own payment method on it. We do not hold your advertising money, we do not take a percentage of it, and we never become responsible for it.
Advertising platforms set their own rules, prices, approval decisions and policies. They may reject an advertisement, suspend an account or change costs without notice and without explanation. We will work to resolve such issues but we do not control them and we are not liable for them.
You are responsible for the truth of any claim you ask us to publish about your business, including claims about pricing, guarantees, qualifications and results.
You own your domain name, your content, your photographs, your advertising account and your customer list. You own the finished website as delivered, once fees due for it have been paid.
We retain ownership of our own underlying methods, templates, automation structures and internal documentation. Nothing here gives you a licence to resell those to anyone else.
Unless you ask us not to, we may describe the work publicly and name your business as a client. You can withdraw that permission at any time by telling us.
The Foundation bundle runs month to month from the start. The Growth bundle has a short minimum term beginning when the advertising trial ends, as set out in your order form, after which it also runs month to month.
Either of us may end the arrangement with thirty days written notice, unless a minimum term is still running. Fees already paid for the current month are not refunded. On termination we will pause campaigns, hand over your accounts and export your contacts on request.
We may end an engagement immediately if you ask us to do something unlawful, misleading or in breach of an advertising platform's rules.
We do not guarantee any number of enquiries, bookings, customers or any amount of revenue, and nothing on this website or in any conversation should be read as such a guarantee. Results depend on your trade, your pricing, your service area, your budget, the quality of your work and how quickly you respond to the customers we send you.
Any figures, sample reports or examples shown on this website are illustrations of a format. They are not claims about past performance and they are not a forecast.
We provide the services with reasonable skill and care. Beyond that, the services are provided as they are, without further warranties.
We are not liable for indirect or consequential losses, lost profits, lost business or lost data. Our total liability for any claim arising out of the services is limited to the fees you have paid us in the three months before the claim arose. Nothing here limits liability that cannot lawfully be limited.
You agree to cover us against claims arising from content you supply, claims you ask us to publish, your use of customer contact lists, or your breach of these terms.
Each of us will keep the other's non public business information confidential and use it only for the purpose of the engagement.
The services depend on platforms operated by others, including the customer relationship platform, hosting providers, payment processors and advertising networks. Their availability, pricing and rules are outside our control. Where registration with a carrier or platform is required before messaging can begin, approval times are set by that platform and may delay launch.
These terms are governed by the laws of the State of Connecticut, and the courts of Connecticut have jurisdiction over any dispute. Before starting proceedings, both of us agree to try to resolve the matter by talking about it.
If any part of these terms is unenforceable, the rest continues to apply. A delay in enforcing a term is not a waiver of it. These terms, together with any order form, are the whole agreement between us. We may update these terms, and material changes affecting existing clients will be sent by email before taking effect.
